Information about OCCOG’s lawsuit vs. HCD

At its May 27, 2021 Board Meeting, the OCCOG Board of Directors unanimously voted to file a writ of mandate against the California Department of Housing and Community Development (HCD).  The writ was filed June 21, 2021.  On November 18, 2021, the court ruled to dismiss the lawsuit.  The OCCOG Board voted to appeal the decision at their December 6, 2021 Board Meeting.   

OCCOG and the individual plaintiff cities filed their opening brief of appeal on December 13, 2022.  On December 23, 2022, the Attorney General’s Office (on behalf of HCD) and SCAG’s legal counsel requested an extension of time to file their responsive briefs and we agreed on behalf of OCCOG and individual cities as these extension requests are routinely granted by courts of appeal anyway.  The Second District Court of Appeal upheld the superior court ruling on July 27, 2023.

On August 24, 2023, the OCCOG Board voted unanimously to direct OCCOG’s General Counsel office to file a Petition for Review with the California Supreme Court challenging the Court of Appeal’s decision.
